Terms & Conditions

Before we get started, please read this. These Terms & Conditions cover everything from payments and sessions to your health, privacy, and how we work together. They apply to all WS Performance services, including personal training, online coaching, programming, and nutrition guidance. By purchasing a WS Performance service, completing payment, ticking the acceptance box in Stripe, or continuing to participate in coaching, you confirm that you have read, understood, and agreed to these Terms & Conditions.

What We Offer

WS Performance provides personal training and coaching services built around your goals and the plan you have chosen.

Services may include:

  • Personal training sessions
  • Exercise programming and structured training plans
  • Online coaching
  • Nutrition education and lifestyle guidance
  • Progress tracking and evaluation
  • Accountability and ongoing support

A quick note on nutrition: any guidance provided is general education and lifestyle support. It is not a substitute for advice from an Accredited Practising Dietitian or qualified healthcare professional. If you have specific dietary needs, a medical condition, injury, or health concern, please speak to the right professional before starting.

Your Responsibilities

Getting the most out of coaching is a two-way street. By joining WS Performance, you agree to:

  • Participate voluntarily, understanding that training includes physical activity such as resistance work, cardio, and bodyweight exercises
  • Disclose any injuries, medical conditions, limitations, medications, or health concerns that could affect your ability to train safely
  • Seek medical clearance where appropriate before starting or continuing training
  • Take ownership of your results. They depend heavily on your consistency, effort, and communication
  • Communicate honestly and respectfully throughout the coaching process

WS Performance provides the structure, guidance, and support. Doing the work is on you. That is where the results happen.

Results

WS Performance does not guarantee specific results. Every person is different, and outcomes depend on a range of factors including:

  • Training consistency and effort
  • Nutrition adherence
  • Lifestyle habits, sleep, and stress
  • Medical history and genetics
  • Communication and attitude

What WS Performance does guarantee is coaching, education, accountability, and support to help you work toward your goals. The rest is a partnership.

Payments & Billing

WS Performance operates on a subscription-based or upfront payment arrangement, depending on the plan you have selected.

  • All payments are processed securely through Stripe unless otherwise agreed in writing
  • By purchasing, you authorise WS Performance and Stripe to process payments according to your selected plan and billing cycle
  • Payments may be processed weekly, fortnightly, monthly, upfront, or through another agreed structure

Minimum Term

Coaching plans operate on a fixed minimum term of 12 weeks, unless otherwise stated.

This exists for a reason: real, lasting results need time. 12 weeks gives us enough room to build structure, track progress, create accountability, and get you moving in the right direction.

By purchasing a 12-week plan, you agree to complete the full minimum term and remain responsible for all payments within that plan. Payments do not automatically cancel before the end of the agreed term unless WS Performance agrees in writing.

Failed Payments

If a scheduled payment fails, WS Performance may:

  • Request that you update your payment method
  • Pause coaching services until payment is resolved
  • Withhold future sessions, programming, check-ins, or support
  • Continue attempting payment collection through Stripe
  • Cancel or terminate services if payment remains unresolved

A failed payment does not cancel your financial responsibility. Any outstanding balance must be paid in full.

Refund Policy

All payments for WS Performance services are final and non-refundable, except where required by law or where WS Performance is unable to deliver the agreed service.

Refunds will not be provided for:

  • Change of mind
  • Lack of attendance, adherence, or effort
  • Unused, missed, or forfeited sessions
  • Missed check-ins or failure to communicate
  • Early termination by the client
  • Failure to complete the program

If WS Performance is unable to deliver an agreed session or service, WS Performance will make reasonable efforts to reschedule the affected session. Refunds will only be considered where rescheduling is not reasonably possible, or where required by law.

Nothing in these Terms & Conditions limits any rights you may have under Australian Consumer Law.

Session Duration, Late Arrivals & No-Shows

  • Personal training sessions are scheduled for 45 minutes unless otherwise agreed
  • Clients are expected to arrive on time
  • If you are late, the session will still finish at the scheduled time. No additional time will be added
  • If you are more than 15 minutes late, the session may be treated as a no-show and the full session fee may apply

WS Performance operates by appointment to ensure every client gets dedicated, focused time.

Rescheduling & Cancellations

  • At least 24 hours' notice is required to reschedule a session
  • Where 24 hours' notice is provided, WS Performance will do its best to accommodate a rescheduled session within your plan timeframe, subject to availability
  • Sessions cancelled or rescheduled with less than 24 hours' notice may be forfeited and charged at the full session rate
  • Each client may receive one short-notice reschedule at no charge, provided WS Performance is notified before the session start time. This is offered at WS Performance's discretion
  • A medical certificate or supporting evidence may be requested where appropriate
  • Repeated late cancellations, short-notice reschedules, or no-shows may result in services being paused, reviewed, or terminated

Duo Coaching Terms

Duo Coaching is designed for two participants training together within the same scheduled session time.

By joining a Duo Coaching plan, participants agree that:

  • Duo Coaching sessions are scheduled as one shared appointment
  • If one participant is unable to attend a scheduled session, the session will still proceed for the attending participant
  • Missed sessions will not be rescheduled separately for the absent participant
  • If both participants are unable to attend, the standard rescheduling and cancellation policy applies
  • Each participant is responsible for logging their own training, progress, and check-ins within the coaching app where required
  • If one participant chooses to discontinue the program, WS Performance reserves the right to transition the remaining participant to an available 1:1 coaching plan or another suitable arrangement

Duo Coaching plans remain subject to all other applicable Terms & Conditions, including payment, cancellation, and minimum commitment requirements.

Session Expiry & Package Timeframes

Sessions must be used within the agreed plan timeframe.

  • Unused sessions do not automatically roll over beyond the plan term unless approved by WS Performance in writing
  • Rescheduled sessions are subject to availability and must be completed within the agreed coaching period where possible

Holidays, Travel & Trainer Leave

Life happens. Here is how we handle it on both sides:

  • Clients are responsible for managing their availability around planned holidays, travel, public holidays, or personal commitments
  • If you are travelling or unable to attend in person, sessions may be rescheduled with at least 24 hours' notice, subject to availability
  • WS Performance may be unavailable during public holidays, planned leave, illness, or other reasonable business interruptions
  • WS Performance will aim to provide at least 1 week's notice of planned leave where possible
  • If WS Performance is unavailable due to planned leave, affected sessions and payments may be paused or rescheduled as appropriate

Online Coaching Expectations

Online coaching works best when communication is consistent and honest. For online services, clients acknowledge that progress depends heavily on communication, completing check-ins, and showing up for the process.

Online coaching may include:

  • Training plans and program adjustments
  • Nutrition guidance
  • Check-ins, messaging support, and progress reviews
  • App-based tracking

Clients are responsible for submitting check-ins, progress updates, training feedback, and requested information honestly and on time.

  • Coach support is provided through approved communication channels only
  • WS Performance aims to respond to online coaching messages within 1 to 2 business days where possible
  • Response times may vary depending on schedule, business hours, client load, public holidays, or planned leave
  • Online coaching does not include 24/7 support unless specifically agreed in writing

Program Adjustments

WS Performance may adjust your training program, nutrition guidance, session delivery, or coaching structure based on:

  • Your progress and feedback
  • Attendance and compliance
  • Injuries, limitations, or lifestyle factors
  • Safety considerations and professional judgement

These adjustments are always made with your progress and wellbeing in mind.

Health, Medical & Injury

Exercise involves inherent risk. By participating in WS Performance services, you acknowledge that physical activity may carry a risk of injury, illness, discomfort, or aggravation of existing conditions.

You agree to:

  • Inform WS Performance of any relevant medical conditions, injuries, pain, symptoms, or limitations
  • Stop exercising immediately if you experience dizziness, chest pain, unusual shortness of breath, severe pain, or any concerning symptoms
  • Seek medical advice where appropriate
  • Follow instructions and use equipment safely

WS Performance is not a medical provider and does not diagnose, treat, or manage medical conditions. Clients participate voluntarily and accept responsibility for their own health and safety.

Client Conduct

WS Performance is built on respect. For yourself, for others, and for the process. Clients are expected to behave respectfully toward WS Performance, other clients, gym staff, and any third-party facility.

WS Performance reserves the right to pause or terminate services immediately in cases of:

  • Non-payment
  • Inappropriate conduct, harassment, or abuse
  • Unsafe behaviour or failure to follow safety instructions
  • Repeated policy breaches
  • Conduct that affects the training environment or business reputation

Early Termination

If you choose to end your agreement before the agreed plan term is complete, you remain liable for the full plan fee. Any outstanding balance must be paid in full at the time of termination, unless otherwise agreed in writing by WS Performance.

Non-Transferable Services

WS Performance plans, sessions, subscriptions, and coaching services are non-transferable. They cannot be transferred, sold, gifted, or assigned to another person without written approval from WS Performance.

Intellectual Property

All programs, training plans, videos, documents, resources, check-in systems, educational materials, and coaching content provided by WS Performance remain the intellectual property of WS Performance.

Clients may not copy, reproduce, share, sell, distribute, or use WS Performance materials for commercial purposes without written permission.

Privacy & Confidentiality

Your information is treated with respect and kept confidential. WS Performance will use client information only for the purpose of providing coaching, training, communication, billing, and related support. It will not be shared with third parties without your consent, unless required by law or necessary for service delivery.

This includes:

  • Contact details
  • Health information voluntarily provided
  • Training history, progress updates, photos, and measurements
  • Payment-related information processed through Stripe

Photos, Videos & Progress Tracking

WS Performance may request progress photos, videos, measurements, or training footage to support your coaching and progress tracking.

  • These materials will be used for coaching purposes only, unless you give separate permission for marketing, social media, or promotional use
  • WS Performance will not publicly share identifiable client photos, videos, or results without your consent

Limitation of Liability

To the maximum extent permitted by law, WS Performance is not liable for any injury, illness, loss, damage, expense, or claim arising from participation in coaching, training, exercise, nutrition guidance, or related services. This excludes cases of proven negligence or where liability cannot be excluded by law.

Clients participate voluntarily and accept the risks associated with exercise and lifestyle change.

Changes to These Terms

WS Performance reserves the right to update or amend these Terms & Conditions at any time. The latest version will always be available on the WS Performance website.

Continued use of WS Performance services after updates are published constitutes acceptance of the updated Terms & Conditions.

Acceptance of Terms

By purchasing a WS Performance service, completing checkout, ticking the acceptance box in Stripe, or continuing to participate in coaching, you confirm that:

  • You have read these Terms & Conditions
  • You understand them
  • You agree to be bound by them
  • You accept responsibility for your participation in WS Performance services
